Attorney for Rudy Giuliani says he's the target of probe into attempted overturn of 2020 election: 'We know how to play hardball'

An attorney for Rudy Giuliani said that he is the target of an investigation into the attempted overturn of the 2020 election by Atlanta-area prosecutors.

Giuliani attorney's Robert Costello confirmed Monday that special prosecutor Nathan Wade informed them of the change in Giuliani's designation from a "material witness" in the investigation into the alleged "coordinated attempts to alter the outcome of the 2020 election."

The former New York City mayor had been initially subpoenaed by the grand jury in July in the investigation by the Fulton County District Attorney's office.

“This comes on the heels of us asking him probably six or seven times," said Costello about whether Giuliani was a target of the investigation. He went on to say the district attorney's office had declined to answer the question previously.

Costello told CNN that Giuliani would appear before the grand jury but he hinted that he may not be too cooperative.

“If they want to play hardball, we know how to play hardball,” he added.

Giuliani was pivotal in the campaign to question the official results in the 2020 election when he acted as the personal attorney to former President Donald Trump.

He also responded to the development on his WABC radio program on Monday.

"I don't know what it's an investigation of. Except I have a hard time with it as a lawyer but I'll figure it out because they've screwed up the system of justice so much, I can usually figure out what crooks like this are doing," Giuliani laughed.

"So it's really risky. You get indicted there, you might as well plead guilty," he said of Atlanta. "They're going to find you guilty if you're not a Democrat."

Fulton County District Attorney Fani Willis, a Democrat, said the investigation includes possible charges of “solicitation of election fraud, the making of false statements to state and local governmental bodies, conspiracy, racketeering, violation of oath of office and any involvement in violence or threats related to the election’s administration.”

In July, Willis informed 16 state Republican officials and Trump supporters who had claimed to be qualified presidential electors that they were also targets of the investigation.
