Leftists celebrate 'hero' who leaked Supreme Court opinion draft overturning abortion: 'More of this please'

Leftists celebrated the leak of a forthcoming Supreme Court opinion that indicated Roe v. Wade will be overturned.

Politico stunned the nation late Monday when it published a 98-page draft, purportedly written by Supreme Court Justice Samual Alito, that indicated the Supreme Court has voted to overturn notorious legal precedents protecting abortion.

The decision of whether abortion should be legal, Alito purportedly said, should be returned to the people and states, the democratic method enshrined in the Constitution. The leaked draft, however, has not been officially authenticated, although its language and legal depth strongly suggest Alito authored it.

What are leftists saying?

Immediately after Politico published the draft opinion, leftists celebrated the person who leaked it.

  • Ian Millhiser, a legal journalist: "Seriously, shout out to whoever the hero was within the Supreme Court who said 'f*** it! Let’s burn this place down.'"
  • Brian Fallon, who worked for the Clinton campaign: "Is a brave clerk taking this unpredecented step of leaking a draft opinion to warn the country what's coming in a last-ditch Hail Mary attempt to see if the public response might cause the Court to reconsider?"
  • Jay Willis, editor of a progressive outlet covering law: "[S]houtout whichever clerk for a liberal justice said 'f*** this bullshit' and sent politico a pdf, more of this please."
  • Jill Filipovic, a lawyer: "Shoutout to whatever Supreme Court clerk just risked their career giving us this heads up and a last chance to show just how much of an unmitigated, divisive, ugly s***show it's going to be if the Court overturns Roe. I doubt it will make a difference. Thanks all the same. ... Or alternately, f*** you to the conservative Supreme Court clerk who did this."

But what is the problem?

Constitutional scholar Jonathan Turley explained why the leak is "one of the greatest breaches of security in the history of the court," describing it as the "original sin for judicial ethics ..."

"The opinion can change but the damage done to the court as an institution will likely be lasting. This shattered a long tradition of the court of strict secrecy and integrity in the handling of drafts," Turley later wrote in a brief essay.

Supreme Court news website SCOTUSblog similarly observed, "It’s impossible to overstate the earthquake this will cause inside the Court, in terms of the destruction of trust among the Justices and staff. This leak is the gravest, most unforgivable sin."

While it remains unclear how the court will respond, Chief Justice John Roberts will likely initiate an investigation, with the help of the FBI, to determine who leaked the opinion draft. There is a very small number of people who have access to such documents, so discovering the source probably will be relatively easy.
