(UPDATED) Don Lemon's attorney sends letter of complaint to Megyn Kelly after she invited his accuser on her podcast: Report

An attorney for Don Lemon has reportedly sent a letter to Megyn Kelly after she had the audacity to invite his assault accuser on her podcast to recall the sordid details of his allegations.

What's a brief history here?

Firner bartender Dustin Hice has alleged that Lemon, who was visiting a Hamptons-area bar in 2018, assaulted him with vulgar and inappropriate touching.

The incident reportedly took place after Hice offered to buy Lemon a drink at the bar, which Lemon refused. Later that evening, Hice said, Lemon accosted him and assaulted him.

A portion of the suit alleged, "Mr. Lemon, who was wearing a pair of shorts, sandals, and a T-shirt, put his hand down the front of his own shorts and vigorously rubbed his genitalia, removed his hand and shoved his index and middle fingers into Plaintiff's mustache and under Plaintiff's nose."

"Lemon intensely pushed his fingers against Plaintiff's face under Plaintiff's nose, forcing Plaintiff's head thrust backward as Defendant repeatedly asked Plaintiff 'Do you like p***y or d**k?' While saying this, Mr. Lemon continued to shove his fingers into Plaintiff's face with aggression and hostility," the suit then alleged.

Lemon in response to the initial compliant denied all wrongdoing and called Hice's lawsuit "frivolous."

Hice told Fox News Digital that the suit continues and that, despite a lengthy discovery process, it could end up in court around January 2022.

Kelly, a longtime broadcaster, recently invited Hice on her show to recall the finer details of his lawsuit against the CNN host.

In a Wednesday report from the Daily Wire, however, Lemon's attorney was said to have sent a letter to Kelly complaining that she offered Hice an audience to retell his story.

The letter, obtained by Radar Online, accused Kelly of providing a "lopsided and inaccurate" version of what reportedly took place between Lemon and Hice.

The attorney, Caroline Polisi, also accused Kelly of paying “lip service to journalistic ethics."

“Although you advertise your podcast as featuring 'honest' conversations without 'BS' or 'agenda,' your podcast today, in which you interviewed Dustin Hice, reveals that you only pay lip service to journalistic ethics," another portion of the letter added.

The letter added that the filings on the public docket “substantially undermines Mr. Hice's credibility and as well as the outlandish story he fabricated about Mr. Lemon" and said that Lemon has "presented evidence of Mr. Hice offering to bribe a witness and that he intentionally destroyed and withheld material evidence that both is directly relevant to his purported claims and that severely undermines his credibility."

Update 11/11/2021, 10:53 a.m. ET: Robert Barnes, an attorney for Hice, later addressed the accusations from the letter directly with Kelly.

Barnes told Kelly, "One of the reasons why I got involved in the case is because here you have one of the most powerful media networks in the world, waging war against a bartender from the Hamptons who was assaulted. ... I was offended by that. Here you have a powerful media institution trying to crush a little guy. Not try to investigate to get to the bottom of it, not try to resolve it, not try to mediate it ... but instead, come to bat for their million-dollar anchor and support lies against an innocent kid. It's deeply morally offensive how they tried to leverage their power and influence to bully and intimidated an ordinary person."

Barnes added that it's as simple as Hice wanting acknowledgement and apology, and isn't in the suit for financial compensation.

"Don Lemon's people say this case is about money," Barnes said. "Dustin has authorized me to offer a settlement that if he confesses and apologizes, we'll dismiss the case entirely with prejudice without a penny, nickel, dime, or dollar being paid. So if they're serious about rectifying and remedying this, they they can take action. This case isn't about money — it's about justice."
