Democrat DA under fire for allegedly complimenting colleague's 'magnificent boobs,' calling others 'slut bag' and fat

A district attorney in Vermont may face impeachment after several colleagues accused him of repeatedly making insensitive and demeaning comments.

On Thursday, the Vermont Department of State’s Attorneys and Sheriffs released a redacted report of an investigation into Franklin County State’s Attorney John Lavoie. Lavoie has spent decades as a prosecutor but was elected to the top spot in Franklin County just last November, and now he's facing serious pushback after a career of off-color "banter."

The majority of the accusations made against Lavoie involve women and their physical appearances. He is alleged to have made a comment about one colleague's "magnificent boobs" and to have repeatedly referred to another woman as a "whore" and perhaps even a "slut bag."

He is said to regularly use the "c word," the report stated, and to criticize women's weight and eating habits. When a young woman once asked about what she should have for lunch, Lavoie allegedly "responded by pinching her midsection and saying 'I don't think you need to eat today," the report claimed. On another occasion, an employee discussed purchasing a piece of exercise equipment, and Lavoie supposedly replied, "[O]h yeah, those are for fat people like you."

However, Lavoie, a Democrat, did not restrict his politically incorrect humor to women and their physiques, the report alleged. He also supposedly crudely joked that a woman was a lesbian after she took a trip with a female friend and told another that "there's nothing worse than an ... Irish Jew." There were even allegations that he used the N-word, but the report claimed that no "support" for those allegations could be found.

The report claimed that Lavoie regularly used various versions of the word "retard," including "f***tard." "I guess you aren't the office retard, maybe you are just autistic or maybe it is just Asperger's," he once supposedly said to an office employee. He even allegedly used the word in reference to a client with limited cognitive abilities.

Some of those targeted by Lavoie's jokes reported experiencing physical ailments, such as stomachaches, on account of his humor. Others allegedly burst into tears, adjusted their eating habits, or even sought counseling.

While Lavoie denied several of the most offensive allegations listed on the report, he also copped to others, positioning himself as an old man from a bygone era. But he also insisted that he has always had the same sense of humor and that his jokes are all meant in good fun. "These are not people that I’ve met two, three months ago. These are people I’ve been with for 20 years," he said.

"I am the same guy that I have been all that time," he told reporters, "and I guess I have to apologize for now suddenly being out of step, maybe, with the times."

Lavoie is not the only Franklin County official who faces possible impeachment. Sheriff John Grismore is also under fire for allegedly kicking a "shackled" suspect during an interrogation which occurred before his election, the VT Digger reported. Like Lavoie, Grismore was first elected last November and took office in January. Despite calls for their resignations, both men have adamantly refused to step down.

House Speaker Jill Krowinski (D-Burlington) claimed that she will impanel a special committee to investigate both Lavoie and Grismore. However, with the legislative session about to end in just a few days, voting for impeachment may become tricky. No Vermont official has been impeached since 1976, and no official has been convicted from an impeachment in the state in nearly 240 years — since 1786.
