Australian vegan is offended by the smell of her neighbors' barbecue. So she took them to court.

'They've put it there so I smell fish, all I can smell is fish'

A vegan who lives in the suburbs of the Australian city of Perth is suing both of her next door neighbors over noise complaints, cigarette smoke complaints, and accusations that they grill fish just to annoy her.

What's the story?

According to vegan and massage therapist Cilla Carden, her neighbors are trying to make her life difficult by barbecuing.

"They've put it there so I smell fish, all I can smell is fish. I can't enjoy my backyard, I can't go out there," she told Australia's 9News.

In addition, she said that the smell of cigarette smoke from next door is intolerable, as were the noises.

"They just bang the wall at any time while I've been sleeping," she said. "Then the kids with their basketballs, just banging and vibrating — it vibrates this part of the house. It's been devastating. It's been turmoil. It's been unrest. I haven't been able to sleep."

And Carden insisted that these transgressions were not accidental: "It's deliberate, that's what I told the courts, it's deliberate."

After having her case thrown out in a lower court, Carden took it before the Supreme Court of the state of Western Australia — which also ruled against her. But she promised that she will continue to fight.

What else?

At least one of Carden's neighbors told 9News that he had already removed the offending barbecue completely in an attempt to keep the peace and had instructed his children to stop playing basketball at their house.
